The text below constitutes an agreement between the website egoestbtq.com (hereinafter referred to as the Online Store) and an individual who has visited at least one page of the website or used at least one of the services provided within the framework of the website, including without prior registration and authorization on the website (hereinafter referred to as the Buyer).

1. General Provisions

1.1. This Agreement is a public agreement – offer (in accordance with Articles 633, 641, and Chapter 63 of the Civil Code of Ukraine) and contains all essential terms of organizing the purchase and sale remotely, i.e., through the online store.
1.2. In accordance with Article 642 of the Civil Code of Ukraine, the full and unambiguous acceptance of the terms of the public agreement, i.e., the public offer of the online store, is the act of placing an order by clicking on the "Place Order" link in the cart and paying for the order in the amount of 100% under the terms of this agreement.
1.3. The public offer is also considered accepted upon the Buyer’s registration on the website of the online store.
1.4. By entering into this Agreement, the Buyer confirms that they are fully and completely familiar with and agree to its terms, and if the Buyer is a natural person, they give consent to the processing of their personal data for the purpose of fulfilling the terms of this Agreement, the possibility of conducting settlements, as well as for receiving invoices, acts, and other documents. The consent to the processing of personal data is valid for the entire term of the Agreement. In addition, by entering into this Agreement, the Buyer confirms that they have been informed (without additional notice) of their rights established by the Law of Ukraine "On Personal Data Protection" and about the purposes of data collection. The scope of the Buyer’s rights as a personal data subject under the Law of Ukraine "On Personal Data Protection" is known and understood by them.

2. Terms and Definitions

2.1. Online Store – the website of the Seller (egoestbtq.com), created for concluding retail purchase and sale agreements based on the Buyer’s familiarization with the description of the Goods offered by the Seller through photographs, using the Internet, excluding the possibility of the Buyer’s direct familiarization with the Goods – a remote means of selling goods.
2.2. Goods – a list of item names presented in the online store.
2.3. Product Card – a set of information about the product, which includes the product name, images of the product on the website, its description, price, characteristics, color, size, set, availability in the store, and more.
2.4. Order – a properly executed and placed request by the Buyer addressed to the Seller for the purchase and delivery of the selected Goods at the address specified by the Buyer.
2.5. Order Value – the amount payable upon receipt of the order by the Buyer, after applying discounts or bonuses.
2.6. “Place Order” – the decision of the Buyer to purchase the product, executed in the online store.
2.7. “Personal Data” – any information voluntarily provided by the Buyer during registration and/or ordering on the Website, necessary for the execution of the order by the Online Store.

3. Subject of the Agreement

3.1. The Online Store undertakes to transfer ownership of the goods to the Buyer, and the Buyer agrees to pay for and accept the goods under the terms of this agreement.
3.2. This agreement regulates the purchase and sale in the online store, including:
a) voluntary selection of goods by the Buyer from “Categories”;
b) independent ordering by the Buyer in the online store;
c) payment by the Buyer for the order placed in the online store;
d) execution and transfer of the order to the Buyer for ownership under the terms of this agreement.

4. Order Placement Procedure

4.1. The Buyer independently places an order online in the online store or via telephone communication using the contact information provided on the website.

5. Price and Payment Procedure for Goods

5.1. The full price of the goods is indicated on the pages of the Seller's online store.
5.2. The Buyer pays for the order by any method chosen in the online store.
5.3. The delivery cost of the order is paid by the Buyer upon receipt of the order.
5.4. Prices for Goods and services may change depending on market conditions, which is reflected in the prices in the online store. The Seller cannot change the price for a specific Buyer if they have already accepted the Seller’s terms and made payment for the Goods (services) in the manner specified by this agreement.

6. Order Delivery

6.1. The delivery of the ordered Goods is carried out within a period of 1 (one) to 3 (three) business days from the moment of order confirmation by the manager, but in any case not later than thirty days from the moment of order confirmation.
6.2. Delivery methods are described in detail in the "Questions and Answers" section of the website.
6.3. Upon receipt of the Goods, the Buyer inspects them for compliance with the Order, checks the quality and quantity of the Goods, their integrity, completeness. The Buyer has the right to refuse the ordered Goods entirely, specifying the reason in the relevant documents.
6.4. The cost of delivery is not specified in the online store, as it depends on the current rates of the shipping company (carrier).
6.5. The Seller is not responsible for the delivery time of the order, as it depends on the actions of third parties (carriers).
6.6. The Buyer has the right to receive the Order at the branch of the Courier Company within 5 (five) business days, including the day of receipt of the shipment (Order) at the recipient’s (Buyer’s) branch. If the Order has not been claimed by the Recipient (Buyer) within the specified period, such shipment (Order) is considered unclaimed (canceled at the Buyer’s initiative) and is returned to the Seller.

7. Order Return Procedure and Refund

7.1. The Buyer has the right to return the Goods of appropriate quality within fourteen days from the date of receipt of the Goods at the branch of the Courier Company if the Goods do not satisfy them in terms of shape, dimensions, style, color, or for other reasons cannot be used for their intended purpose after receiving the Order. The return of Goods of appropriate quality is carried out if they have not been used and if their commercial appearance, consumer properties, seals, tags, and packaging are preserved.
7.2. In the case of returning Goods of inadequate quality, the Buyer has the right to return them at the Seller’s expense. In this case, the refund of the cost of the goods, including the cost of delivery, occurs within 10 (ten) business days from the moment the returned goods are received by the Seller.
7.3. In the case of returning Goods of appropriate quality, the return costs are borne by the Buyer, and the refund of the cost of the Goods occurs within 10 (ten) business days from the moment the returned goods are received by the Seller.

8. Liability of the Parties

8.1. The Seller is not liable for damages caused to the Buyer due to improper use of the product.
8.2. The Parties are exempt from liability for improper fulfillment of obligations under this agreement in the event that such improper fulfillment occurred due to the action of force majeure circumstances.
8.3. In the event of improper fulfillment of obligations under this agreement, the guilty party must compensate the other party for all damages caused by their actions, including lost profits, except in cases where such damages occurred due to the action of force majeure circumstances.

 

9. Dispute Resolution

9.1. All disputes and disagreements arising from this Agreement are resolved through negotiations between the parties. If an agreement cannot be reached, the dispute will be submitted for consideration to the court at the location of the Seller.

10. Final Provisions

10.1. This Agreement is concluded for an indefinite term.
10.2. The Seller reserves the right to change this Agreement at any time, with changes taking effect from the moment they are published on the Website.
